Terms & Conditions

In order to serve you better Dial An Exchange Pty Ltd (Australia: ACN 078 812 469 ABN 11 078 812 469 - GST Registration No.; New Zealand Company No: AK/1139201 IRD No: 79-121-207), have developed a number of simple terms and conditions that act as guidelines for the interaction between Dial An Exchange (DAE) and its members. If you have any queries relating to any of the conditions outlined below, please call one of our team and they will be happy to help you with your enquiries.

The Terms of Your Deposit

1. The maintenance levy on the week you are depositing must be paid in full prior to final confirmation of your exchange. 2. The week you are depositing for your exchange has not been utilized or assigned to another party or company. You must not deposit your week with more than one Exchange Company at a time, in any one entitlement period, as this will cause an overbooking of your unit. Any expenses incurred to an inbound guest or DAE, denied access to your week as a result of a double banking with another Exchange Company, will be your responsibility. 3. A number of resorts like to bank the weeks on their owner's behalf. Please check with your resort if you are unsure of their procedures, or we can advise you which resorts operate on this basis. 4. We will happily accept the week you wish to bank up to eight (8) weeks prior to the expiry date (or check-in date) of your time. We still need a little bit of time in which to find someone to use your deposited week. Late deposits (a late deposit is when the week you have allocated at your resort falls within eight (8) weeks of the date of check in) - we can only accept a late deposit if we have a request from another member who is happy to accept your week as exchange. We will always do our best to help you out and find someone who can use your week.

Credit - Exchange Certificate (Bank & Save option)

We will gladly bank weeks for you and as a member with Dial An Exchange; you will be issued with a "Credit - Exchange Certificate". This Credit - Exchange Certificate is valid for three (3) years from the date of deposit, and is available for you to exchange against at a future date. You are reminded to request early and make sure you get a confirmed exchange reservation against this Credit before the expiry date.

Our Cancellation Policy

We understand that circumstances sometimes change and plans are altered at the last minute. Where we can, we will always try our best to accommodate special circumstances once you have paid for your confirmed exchange. Dial An Exchange offers members the option of taking out a "Cancellation Protection Option" (CPO) at the time of accepting an exchange offer. The cost of the CPO is published on our web site (www.daelive.com). "CPO" is not available on Bonus Weeks or any other "special" or "promotional offers". We ask members to be fair and use "CPO" for its intended purpose, and not to misuse it. "Cancellation Protection Option" (CPO) can not be used to cancel a confirmed exchange reservation and then rebook the same holiday as either a Bonus offer or a Promotional offer. Conditional upon Dial An Exchange receiving cancellation advice from the member, a minimum of 24 hours prior to the check in date, the following rules apply.

Accepting CPO

Should you need to cancel your exchange holiday, your banked week will be saved for you to use at a later date (up to the original expiry date of your Credit). There will be 'no charge' for the replacement exchange. You have the option of accepting CPO and paying the additional CPO fee on the replacement exchange reservation. No monetary refunds are allowed on cancellations. Replacement exchange must be taken up within 24 months of the cancellation date.

Declining CPO

If you decline CPO at the time of confirming your exchange, the following cancellation policy applies. The exchange fee will be forfeited regardless of the notice given of the cancelled exchange. Cancellation of a confirmed exchange includes any change to dates to a booking. The exchange week (Credit -Exchange Certificate); Cancellations made less than four (4) weeks ahead of the check in date; unfortunately under these circumstances you will also forfeit the week deposited against your exchange .Cancellation of Bonus Time & Rental Reservations. CPO does not apply to Bonus Weeks, Rental Reservations or any other "special" or "promotional" offers. Once paid, you will forfeit the full price if you cancel these reservations.

Cancellation Bonus Time / Rental Weeks

CPO does not apply to Bonus Weeks, Rental Reservations or any other "Special" or "Promotional" offers. Once paid, you will forfeit the full price if you cancel these reservations.

The Rules - Breakages & Damages & Exchangee/Guest Responsibilities

When you exchange your timeshare week at another resort, or accept a Bonus week or any other promotional offer at a resort booked through DAE, you are still responsible (as with your home resort), to abide by the rules and regulations of the host exchange resort. If you are allowing guests to use your time, remember YOU are responsible for their actions. 1. All transactions are between DAE and its members; (not the member's guest). The 'on selling for profit' of confirmed accommodation space provided by DAE to the member, is not permitted or allowed under any circumstances. All confirmations are noted with the name of the person to check-in at the destinations resort. If for any reason this is to change the member, (not the member's guest), must contact DAE and advise the change to the original confirmation details. A new confirmation will be issued by DAE and the destination resort will be notified accordingly. 2. The accommodation or timeshare unit must be left in the same condition as when you first arrived - "Clean & Tidy" 3. Any breakages/damages must be reported immediately to resort staff and you are responsible for the cost of repairs or replacement of items damaged. 4. The Exchangee and or Guest is responsible for any charges incurred at the resort during the holiday - telephone, tours and the like which are charged to your room. 5. Respect the privacy of other guests staying at the resort. Treat the facilities and other owners, as you would wish you, your family and guests to be treated.

Privacy Policy

Commonwealth Privacy Legislation restricts personal information from being disclosed to outsiders by your resort/management company. It is vital for Dial An Exchange to confirm the details and validity of your deposit with your home resort prior to accepting bookings. We require your permission to liaise with your resort/management company to exchange necessary relevant information. By signing the deposit authority, or requesting to deposit a week via our web site, you agree to this "exchange of information" between Dial An Exchange and your resort/management company. Dial An Exchange agrees to keep this information private and confidential at all time and agrees not to pass this information onto any other third party. We do not sell or rent your private information to any other third party. We may provide your information to other offices of Dial An Exchange for internal use only (in relation to reservations made through these offices). These offices are currently located in the United Kingdom, New Zealand, Asia (Bangkok and Shanghai), USA and South Africa. A full copy of DAE's privacy policy is available on our website www.daelive.com or on request from our offices.

Rental Accrual Information (USA office)

Rental Accrual is the term used when you notify Dial An Exchange, and your resort, that you will not be using your own week for a particular year, and you wish, Dial An Exchange to try and rent your unit on your behalf. Our commission for handling this rental will be 20%. Once your unit is placed in the Rental Accrual program, it will remain there until rented, or if not rented at 120 days (4 months) before the check in date of the week, the deposit will revert from being a Rental Accrual to a normal Deposit week for which you will receive a Credit - Exchange Certificate which will be valid for three years to exchange against in the future. The maintenance levy on the week you wish to place in the Rental Accrual program must be paid in full, and that the week can not be used by another person or company. In the event that your week does rent, you will expect to receive your rental check from Dial An Exchange, 30 days after your week is sold. DAE/TC/7-Jun-2005
